Welcome to Yozaly (“we,” “us,” or “our”). By accessing our website (yozaly.com) or engaging our digital marketing, lead generation, or automation services, you (“Client,” “you”) agree to be bound by the following Terms of Service. Please read them carefully before initiating any project or service.

1. Scope of Services

Yozaly provides bespoke lead generation, workflow optimization, digital consulting, and automation services tailored specifically for service-based businesses.

  • Service Limitations: Our agency focuses strictly on high-ticket, service-based sectors. We explicitly exclude and do not offer lead generation strategies, advice, reports, or data management for online stores, retail setups, or e-commerce platforms.

2. No Guarantees & Variance of Results

While we utilize data-driven strategies, proven methodologies, and robust automation infrastructure to optimize performance, Yozaly does not guarantee financial returns, specific conversion rates, or a set volume of leads.

Digital marketing and lead generation performance are inherently volatile and subject to numerous external elements beyond our control. You acknowledge that project results will vary based on variables including, but not limited to:

  • Market demand, economic conditions, and regional fluctuations.

  • The Client’s specific industry sector, target audience size, and local competition.

  • Ad platform algorithm updates (e.g., Meta, Google) and ad spend budgets.

  • The Client’s internal sales team efficiency, response times, and lead follow-up processes.

Any case studies, historical data, or performance examples shared by Yozaly are purely illustrative and do not constitute a promise or guarantee of future outcomes.

3. Performance & Platform Variables

  • Third-Party Disruptions: We build and manage infrastructure using third-party tools (including WordPress, Elementor, Google Apps Script, Meta Ads Manager, and Google Tag Manager). Yozaly cannot be held liable for campaign downtime, tracking inaccuracies, or data delays caused by third-party platform blackouts, API changes, or sudden algorithm updates.

  • Ad Account Management: If campaigns are run through the Client’s advertising accounts, the Client remains entirely responsible for maintaining compliant payment methods and adhering to platform policies. Yozaly is not responsible for ad accounts suspended by platforms like Meta or Google due to policy violations or payment failures.

4. Payment Terms & Flexible Commitments

To keep things simple and accessible for growing service businesses, we operate on a flexible service model:

  • Month-to-Month Agreements: Unless explicitly agreed otherwise in a written project brief, our retainer services operate on a flexible, month-to-month basis with no long-term lock-in contracts.

  • Upfront Billing: Retainer fees and setup costs are billed in advance of the service month.

  • Non-Refundable Services: Due to the immediate allocation of resources, custom script architecture, and labor involved in setting up campaigns, all payments made to Yozaly are strictly non-refundable.

5. Client Responsibilities & Data Handover

Our lead generation systems are designed to deliver inquiries in real-time, but their ultimate business value relies heavily on your internal execution:

  • Lead Handling: The Client acknowledges that lead quality degrades rapidly with time. Yozaly is not responsible for low conversion rates resulting from delayed sales follow-ups or internal CRM mismanagement by the Client’s team.

  • Approvals: The Client must review and approve all marketing materials, ad copy, and landing page content prior to launch. Once approved, the Client assumes full responsibility for the legal compliance and industry-specific regulations of those advertisements.

6. Intellectual Property

  • Our Property: Yozaly retains all rights, titles, and interests in any proprietary automation scripts, custom Google Apps Script code foundations, and workflow strategies developed prior to or during the engagement.

  • Client Property: The Client retains ownership over all brand assets, logos, and pre-existing data provided to Yozaly for campaign execution. Upon full payment of all outstanding invoices, the specific ad copy and creative assets generated explicitly for the Client’s campaign will belong to the Client.

7. Limitation of Liability

To the maximum extent permitted by applicable South African law, Yozaly, its directors, or employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, loss of profits, loss of data, business interruption, or ad spend losses arising out of or in connection with the use of, or inability to use, our services.

Our total cumulative liability for any claim arising out of these Terms shall not exceed the total amount paid by the Client to Yozaly for the specific service module giving rise to the dispute during the one (1) month immediately preceding the incident.

8. Amendments to Terms

Yozaly reserves the right to update, change, or replace any part of these Terms of Service at any time. It is your responsibility to check our website periodically for changes. Your continued use of or access to our services following the posting of any changes constitutes acceptance of those updates.
